We want you to enjoy our products safely. Please:

·         Follow the directions and warnings on the product label.

·         Keep out of reach of children, and store as directed on the label.

5. Placing an order and when the contract is formed

1. When you place an order, you will receive an email acknowledging that we have received it. This is not acceptance of your order.

2. Your order is an offer to buy from us. A contract between you and us is formed only when we send you an email confirming that your order has been dispatched (the "Dispatch Confirmation").

3. We may decline an order before we send the Dispatch Confirmation, for example if a product is out of stock, there is an error in the price or description, or we cannot deliver to your address. If so, we will let you know and refund any payment in full.

If we accept part of your order only, the contract will cover only the items listed in the Dispatch Confirmation.

6. Prices

All prices are shown in pounds sterling (GBP) and "VAT is not charged as we are not VAT registered". Delivery charges are shown separately at checkout before you pay. See our Shipping Policy.

For orders delivered outside the UK, import VAT, customs duties and handling fees may apply. See our Shipping Policy.

We may change our prices from time to time, but changes will not affect orders you have already placed.

7. Errors in pricing or descriptions

We try hard to make sure prices and descriptions are accurate. If we find an error in the price or description of a product you have ordered:

·         before we send the Dispatch Confirmation, we will contact you to ask whether you want to continue at the correct price or cancel your order, and we will refund you in full if you cancel; and

·         if the error is obvious and it would be reasonable for you to have recognised it as a mistake (for example, a price that is clearly far too low), we are not obliged to supply the product at the incorrect price, even after dispatch. In that case we will contact you and offer a full refund.

8. Payment

Payment is taken at checkout through Shopify Payments, which accepts Visa, Mastercard, American Express, Apple Pay, Google Pay, Shop Pay. We do not see or store your full card details. Your payment is authorised when you place your order. If we decline or cancel your order, we will refund any payment taken in full.

9. Gift cards

·         Gift cards are issued in GBP and can be used to buy products on boujibodycare.com only.

·         Gift cards are delivered by email to the address given at checkout.

·         Gift cards can be used over more than one order until the balance runs out.

·         Gift cards are valid until 12 months from the date of purchase.

·         Gift cards cannot be exchanged for cash, and are non-refundable except where required by law or if a gift card is faulty.

·         Please keep your gift card code safe and treat it like cash. We cannot replace a lost or stolen code unless it is shown that the gift card has not been used.

·         Gift cards cannot be used to buy other gift cards.

10. Delivery

We deliver within the UK, including Northern Ireland, Delivery options, prices and estimated times are set out in our Shipping Policy.

Unless we agree a different date with you, we will deliver your order without undue delay and in any case within 30 days of the contract being formed. The products are your responsibility once they are delivered to you, or to someone you have nominated to receive them (such as a neighbour or safe place you have chosen). Until then, they are our responsibility.

11. Your right to cancel and returns

If you are a consumer in the UK or the EU, you have a legal right to cancel your order within 14 days of the day you (or someone you nominate) receive your goods, under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. For hygiene reasons, this right does not apply to sealed cosmetic products that have been unsealed after delivery.

Full details of how to cancel, what can be returned, who pays for return postage and how refunds work are set out in our Cancellation Policy and our Returns & Refund Policy. You can also cancel an order before it has been dispatched, as explained in our Cancellation Policy.

12. Faulty, damaged or incorrect items: your legal rights

We are under a legal duty to supply products that are of satisfactory quality, fit for purpose and as described. Under the Consumer Rights Act 2015:

·         Up to 30 days after delivery: if your item is faulty, damaged or not as described, you can reject it and get a full refund.

·         Up to six months after delivery: if your item cannot be repaired or replaced, or the repair or replacement is also faulty, you are entitled to a full refund in most cases.

·         Up to six years after delivery (five years in Scotland): if your item does not last a reasonable length of time, you may be entitled to some money back.

Cosmetics have a limited life, so what is reasonable will depend on the product and its "period after opening" or expiry date.

If something is wrong with your order, please email support@boujibodycare.com with your order number, a description of the problem and photos if possible. We will pay reasonable return postage costs for faulty, damaged or incorrect items. These rights are in addition to your right to cancel. For more information about your rights, visit Citizens Advice at https://www.citizensadvice.org.uk.

13. Our right to cancel

We may cancel an order, or a contract once formed, if:

·         a product is out of stock or no longer available;

·         there is an obvious pricing or description error (see section 7);

·         we are unable to take payment, or we reasonably suspect fraud; or

·         events outside our reasonable control prevent us from supplying the products (see section 14).

If we cancel, we will tell you as soon as possible and refund any payment you have made in full, including delivery charges, to your original payment method.

14. Events outside our control

We are not responsible for delays or failures caused by events outside our reasonable control, such as severe weather, postal disruption or strikes, or supplier failures. If this happens, we will contact you, take steps to minimise the effect and, if there is a significant delay, you can cancel and receive a full refund for products you have paid for but not received.

15. Our responsibility to you

If we fail to comply with these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breach or our failure to use reasonable care and skill. Loss or damage is foreseeable if it is obvious it will happen, or if both you and we knew it might happen when the contract was made.

We do not exclude or limit our liability in any way where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for breach of your legal rights in relation to the products (including under the Consumer Rights Act 2015), and for defective products under the Consumer Protection Act 1987.

Our products are for domestic and private use only. We are not liable to you for any loss of profit, loss of business or business interruption.

We are not responsible for reactions caused by using a product in a way that does not follow the label directions or the safety advice in section 4, or for reactions to ingredients that were listed on the product page and packaging. This does not affect your legal rights if a product is faulty or not as described.

·         it must not include personal information about other people; and

·         it must not contain medical or health claims about our products.

19. Your personal information

We use your personal information as described in our Privacy Policy.

20. Changes to these terms

We may update these terms from time to time, for example to reflect changes in the law or how we operate. The terms that apply to your order are those shown on our website when you placed it.

21. Complaints and dispute resolution

If you have a complaint, please contact us first at support@boujibodycare.com. We aim to reply within 5 working days and will do our best to resolve it fairly.

Alternative dispute resolution (ADR) is a process where an independent body considers the facts of a dispute and seeks to resolve it without going to court.  "We do not currently use an ADR provider, but you can find out more about your options from Citizens Advice at https://www.citizensadvice.org.uk."

Since the UK left the EU, the EU Online Dispute Resolution platform is not available for UK traders, and that platform has since closed, so it is not available for complaints about orders from us.

22. Governing law and courts

These terms are governed by the law of England and Wales. You can bring legal proceedings in the courts of England and Wales. If you live in Scotland or Northern Ireland, you can also bring proceedings in your local courts. If you live in the EU, you also keep the benefit of any mandatory consumer protection laws of the country where you live.

23. Other important terms

·         If a court finds any part of these terms invalid, the rest will continue to apply.

·         We may transfer our rights and obligations under these terms to another organisation; we will tell you if this happens and it will not affect your rights. You may only transfer your rights to another person with our written agreement (except for gift cards, which you can give to someone else).

·         These terms are between you and us. No other person has any rights to enforce them.

·         If we do not enforce our rights straight away, we can still enforce them later.
